{"id":852,"date":"2024-08-28T14:47:57","date_gmt":"2024-08-28T12:47:57","guid":{"rendered":"https:\/\/blog.fgo.ro\/?p=852"},"modified":"2025-02-19T17:52:19","modified_gmt":"2025-02-19T15:52:19","slug":"buletin-informativ-20-2024","status":"publish","type":"post","link":"https:\/\/www.fgo.ro\/blog\/buletin-informativ-20-2024\/","title":{"rendered":"BI 20\/2024: Aspecte privind demisia salaria\u0163ilor din mediul privat"},"content":{"rendered":"<div class=\"wp-block-post-date\"><time datetime=\"2024-08-28T14:47:57+02:00\">28\/08\/2024<\/time><\/div>\n\n<div class=\"wp-block-post-author\"><div class=\"wp-block-post-author__avatar\"><img alt='' src='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=48&#038;d=mm&#038;r=g' srcset='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=96&#038;d=mm&#038;r=g 2x' class='avatar avatar-48 photo' height='48' width='48' \/><\/div><div class=\"wp-block-post-author__content\"><p class=\"wp-block-post-author__byline\">Expert Fiscal \u0219i Expert Legisla\u0163ia Muncii, acreditat UNELM<\/p><p class=\"wp-block-post-author__name\">Ana Florina Carp<\/p><\/div><\/div>\n\n\n<h2 class=\"wp-block-heading has-x-large-font-size\"><strong>Aspecte privind demisia salaria\u0163ilor din mediul privat<\/strong><\/h2>\n\n\n\n<p>Contractul individual de munc\u01ce poate \u020bnceta ca urmare a demisiei salariatului din func\u0163ia\/postul\/pozi\u0163ia pe care o ocup\u01ce \u020bn cadrul organiza\u0163iei.<br><strong>Demisia<\/strong> <strong>este actul unilateral de voin\u021b\u0103 al salariatului<\/strong> care, printr-o notificare scris\u01ce, comunic\u0103 angajatorului \u00eencetarea contractului individual de munc\u0103, dup\u0103 \u00eemplinirea termenului de preaviz prev\u0103zut \u00een contractul individual de munc\u0103.<\/p>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-c58c69fa941b8d23378c194019ecfa53\"><strong>Demisia:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>poate fi formulat\u01ce de salariat <strong>oric\u00e2nd <\/strong>pe parcursul derul\u01cerii contractului individual de munc\u01ce, indiferent de tipul contractului (cu durat\u01ce determinat\u01ce sau nedeterminat\u01ce, cu norm\u01ce \u020bntreag\u01ce sau cu timp par\u0163ial, cu clauz\u01ce de telemunc\u01ce, cu munc\u01ce la domiciliu);<\/li>\n\n\n\n<li>este o modalitate de <strong>denun\u0163are unilateral\u01ce a raportului de munc\u01ce<\/strong>;<\/li>\n\n\n\n<li>const\u01ce \u020bntr-o notificare scris\u01ce de salariat \u2192 <strong>notificare de demisie<\/strong><\/li>\n\n\n\n<li>se formuleaz\u01ce <strong>\u020bn scris<\/strong>;<\/li>\n\n\n\n<li><strong>nu trebuie motivat\u01ce<\/strong>. Este dreptul salariatului de a nu motiva demisia.<\/li>\n\n\n\n<li>trebuie <strong>s\u01ce fie comunicat\u01ce angajatorului<\/strong> pentru a produce efecte;<\/li>\n\n\n\n<li><strong>se \u020bnregistreaz\u01ce de angajator<\/strong> \u020bn registrul de intr\u01ceri-ie\u0219iri. Refuzul angajatorului de a \u020bnregistra demisia salariatului constituie contraven\u0163ie \u0219i se sanc\u0163ioneaz\u01ce cu amenda de la 1500 lei la 3000 lei.<\/li>\n\n\n\n<li><strong>nu trebuie aprobat\u01ce de angajator<\/strong>;<\/li>\n\n\n\n<li><strong>implic\u01ce respectarea termenului de preaviz de c\u01cetre salariat<\/strong>. Termenul de preaviz este cel stabilit de c\u01cetre p\u01cer\u0163i \u020bn contractul individual de munc\u01ce sau, dup\u01ce caz, cel prev\u01cezut \u020bn contractele colective de munc\u01ce aplicabile \u0219i nu poate fi mai mare de:<br><strong>\u219220 de zile lucr\u01cetoare<\/strong>, pentru salaria\u0163ii cu <strong>func\u0163ii de execu\u0163ie,<\/strong><br><strong>\u219245 de zile lucr\u01cetoare<\/strong>, pentru salaria\u0163ii care ocup\u01ce <strong>func\u0163ii de conducere<\/strong>.<\/li>\n\n\n\n<li><strong>f\u01cer\u01ce preaviz<\/strong> este posibil\u01ce doar prin excep\u0163ie, \u020bn situa\u0163ia \u020bn care <strong>angajatorul nu \u020b\u0219i \u020bndepline\u0219te obliga\u0163iile asumate prin contractul individual de munc\u01ce<\/strong>. <strong>\u020an notificarea de demisie salariatul trebuie s\u01ce includ\u01ce obliga\u021bia din contractul individual de munc\u01ce pe care angajatorul nu a \u020bndeplinit-o<\/strong>. \u020an caz contrar, termenul de preaviz pentru demisie va fi cel prev\u01cezut \u020bn contractul individual de munc\u01ce, ce:<br><strong>\u2192<\/strong>va continua s\u01ce \u020b\u0219i produc\u01ce efectele, \u0219i<br><strong>\u2192<\/strong>va \u020bnceta la data expir\u01cerii termenului de preaviz sau la data renun\u0163\u01cerii totale sau par\u0163iale de c\u01cetre angajator la termenul respectiv, pe toat\u01ce durata preavizului salariatul av\u00e2nd obliga\u0163ia de a se prezenta la lucru.<\/li>\n\n\n\n<li><strong>poate fi revocat\u01ce\/retractat\u01ce de c\u01cetre salariat, doar cu aprobarea expres\u01ce a angajatorului,<\/strong> dac\u01ce este formulat\u01ce astfel:<br>\u2192\u020bn scris, comunicat\u01ce angajatorului;<br>\u2192de c\u01cetre salariatul care a depus notificarea de demisie;<br>\u2192\u020bn interiorul termenului de preaviz;<br>\u2192dac\u01ce nu a intervenit \u020bncetarea contractului individual de munc\u01ce.<br><strong>Angajatorul are dreptul s\u01ce aprobe sau s\u01ce resping\u01ce retractarea demisiei formulat\u01ce de salariat<\/strong>.<\/li>\n\n\n\n<li><strong>are ca efect \u00eencetarea contractului individual de munc\u0103<\/strong> la data expir\u0103rii termenului de preaviz sau la data renun\u0163\u0103rii totale ori par\u0163iale de c\u0103tre angajator la termenul respectiv. <\/li>\n<\/ul>\n\n\n\n<p>\u020ancetarea contractului individual de munc\u0103:\u2192se constat\u01ce de c\u01cetre angajator, printr-o <strong>decizie de constatare<\/strong>;\u2192se completeaz\u01ce \u020bn Revisal \u0219i se transmite c\u01cetre ITM cel mai t\u00e2rziu la data \u020bncet\u01cerii contractului individual de munc\u01ce.<\/p>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-f878ea96a94da5899923343246a7a4fc\"><strong>Pe durata preavizului:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contractul individual de munc\u01ce continu\u01ce s\u01ce \u020b\u0219i produc\u01ce toate efectele.<\/li>\n\n\n\n<li><strong>salariatul este obligat <\/strong>s\u01ce respecte contractul individual de munc\u01ce, <strong>s\u01ce se prezinte la munc\u01ce<\/strong>, s\u01ce respecte programul de lucru \u0219i s\u01ce \u020b\u0219i \u020bndeplineasc\u01ce atribu\u0163iile de serviciu conform fi\u0219ei postului. \u020an caz contrar, asupra lui poate fi angajat\u01ce <strong>r\u01cespunderea disciplinar\u01ce<\/strong>.<\/li>\n\n\n\n<li>pot interveni cauze de suspendare a contractul individual de munc\u01ce, situa\u0163ii \u020bn care <strong>termenul de preaviz va fi suspendat corespunz\u01cetor<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-bd7416ed8cd7197fcd4e91ea3b123017\"><strong>Angajatorul are posibilitatea de a renun\u0163a, \u020bn scris, total sau par\u0163ial la termenul de preaviz:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>printr-un document separat,<\/strong> \u020bntocmit de angajator, \u020bnregistrat \u020bn registrul de intr\u01ceri-ie\u0219iri \u0219i comunicat salariatului.<\/li>\n\n\n\n<li><strong>direct pe notificarea de demisie formulat\u01ce de salariat<\/strong> \u0219i comunicat\u01ce angajatorului, men\u0163ion\u00e2nd c\u01ce renun\u0163\u01ce total sau par\u0163ial la termenul de preaviz, \u0219i specific\u00e2nd data de \u020bncetare a contractului individual de munc\u01ce.
