Prin urmare, poate \u020bncheia un contract individual de munc\u01ce persoana fizic\u01ce ce a \u020bmplinit 16 ani.<br><strong><em>Excep\u0163ie:<\/em><\/strong> Persoana fizic\u01ce poate fi angajat\u0103 \u0219i la \u020bmplinirea v\u00e2rstei de 15 ani, cu acordul p\u01cerin\u0163ilor sau al reprezentan\u0163ilor legali, pentru activit\u01ce\u0163i potrivite cu dezvoltarea fizic\u01ce, aptitudinile \u0219i cuno\u0219tin\u0163ele sale, dac\u01ce astfel nu \u020bi sunt periclitate s\u01cen\u01cetatea, dezvoltarea \u0219i preg\u01cetirea profesional\u01ce.<\/p>\n\n\n\n<p class=\"has-text-align-center has-primary-color has-text-color has-link-color wp-elements-2574593bc93868d50fad383a6faf1d1a\"><strong>Obliga\u021biile angajatorului la angajarea tinerilor sub 18 ani<\/strong><\/p>\n\n\n\n<p>Atunci c\u00e2nd angajatorul \u020bncadreaz\u01ce \u020bn munc\u01ce tineri \u020bn v\u00e2rst\u01ce de p\u00e2n\u01ce la 18 ani trebuie s\u01ce \u0163in\u01ce cont de urm\u01cetoarele aspecte:<\/p>\n\n\n\n<p><strong><em>Informarea \u0219i evaluarea riscurilor<\/em><\/strong><br>-Angajatorul are obliga\u0163ia de a informa, \u00een scris, tinerii asupra eventualelor <strong>riscuri specifice postului<\/strong> \u0219i asupra m\u0103surilor luate \u020bn ceea ce prive\u0219te securitatea \u0219i s\u01cen\u01cetatea lor;<br>-Evaluarea riscurilor specifice postului trebuie realizat\u0103 anterior datei la care tinerii \u020bncep activitatea.<\/p>\n\n\n\n<p><strong><em>Condi\u021bii speciale pentru tinerii \u00eentre 15 \u0219i 16 ani<\/em><\/strong><br>\u00cen cazul tinerilor care au v\u00e2rsta de cel pu\u0163in 15 ani, dar de p\u00e2n\u01ce la 16 ani, angajatorul este obligat:<br><strong>a)s\u0103 informeze, \u00een scris, p\u0103rin\u0163ii sau reprezentan\u0163ii legali ai t\u00e2n\u01cerului <\/strong>asupra tuturor condi\u0163iilor de munc\u01ce, a m\u0103surilor luate \u00een ceea ce prive\u015fte securitatea \u015fi s\u0103n\u0103tatea \u020bn munc\u01ce. Ace\u0219tia analizeaz\u01ce \u0219i \u020b\u0219i exprim\u01ce acordul asupra condi\u0163iilor de munc\u01ce anterior \u020bncheierii contractului individual de munc\u01ce.<br><strong>b)s\u01ce \u020bncheie contractul individual de munc\u01ce doar cu acordul p\u0103rin\u0163ilor sau a reprezentan\u0163ilor legali ai t\u00e2n\u01cerului<\/strong>. P\u01cerin\u0163ii semneaz\u01ce contractul individual de munc\u01ce al\u01ceturi de t\u00e2n\u01cer.<\/p>\n\n\n\n<p><strong><em>Durata timpului de munc\u0103<\/em><\/strong><br>Durata timpului de munc\u01ce pentru tinerii sub 18 ani este de <strong>maxim 6 ore\/zi \u0219i de 30 de ore\/s\u01cept\u01cem\u00e2n\u01ce<\/strong>. Conform Codului Muncii, aceasta reprezint\u0103 <strong>norma \u00eentreag\u0103<\/strong> pentru aceast\u0103 categorie de salaria\u021bi.<br><strong>Recomandare:<\/strong> \u00cen cadrul contractului individual de munc\u0103 cu norm\u0103 \u00eentreag\u0103, \u00eencheiat cu o persoan\u0103 fizic\u0103 ce nu a \u00eemplinit v\u00e2rsta de 18 ani, se recomand\u0103 s\u0103 se eviden\u021bieze clar c\u0103 norma \u00eentreag\u0103 de 6 ore\/zi \u2013 30 de ore\/s\u0103pt\u0103m\u00e2n\u0103 este valabil\u0103 p\u00e2n\u0103 \u00een ziua anterioar\u0103 datei la care salariatul \u00eempline\u0219te 18 ani, iar de la data \u00eemplinirii v\u00e2rstei de 18 ani norma \u00eentreag\u0103 va fi de 8 ore\/zi \u2013 40 de ore\/s\u0103pt\u0103m\u00e2n\u0103, pentru condi\u021bii normale de munc\u0103.<\/p>\n\n\n\n<p><br>\u00cen cazul \u020bn care t\u00e2n\u0103rul cumuleaz\u0103 mai multe func\u0163ii \u00een baza unor contracte individuale de munc\u0103, timpul de munc\u0103 efectuat se \u00eensumeaz\u0103 \u015fi nu poate dep\u0103\u015fi, cumulat, durata de 6 ore\/zi \u2013 30 de ore\/ s\u01cept\u01cem\u00e2n\u01ce.<\/p>\n\n\n\n<p><strong><em>Pauza de mas\u0103 \u0219i munca suplimentar\u0103<\/em><\/strong><br>-Pauza de mas\u0103 este de <strong>cel pu\u0163in 30 de minute consecutive<\/strong>, \u020bn cazul \u00een care durata zilnic\u0103 a <strong>timpului de munc\u0103 este mai mare de 4 ore \u0219i jum\u0103tate<\/strong>;<br>-Tinerii <strong>nu pot presta munc\u01ce suplimentar\u01ce;<\/strong><br>-Tinerii <strong>nu pot presta munc\u01ce de noapte, \u020bntre orele 20:00 \u0219i 06:00.<\/strong><\/p>\n\n\n\n<p><strong>Concediul de odihn\u0103 suplimentar<\/strong><br>Tinerii au dreptul la un concediu de odihn\u0103 suplimentar de <strong>cel pu\u021bin 3 zile lucr\u0103toare<\/strong>. Durata acestuia se stabile\u0219te prin contractul colectiv de munc\u0103 aplicabil. \u020an situa\u0163ia \u020bn care nu exist\u01ce CCM, durata concediului de odihn\u01ce suplimentar se stabile\u0219te prin contractul individual de munc\u01ce, cu condi\u021bia c\u01ce nu poate fi mai mic\u01ce de 3 zile lucr\u01cetoare. Acest concediu de odihn\u01ce suplimentar se acord\u0103 anual, p\u00e2n\u0103 \u00een ziua \u00een care salariatul \u00eempline\u0219te v\u00e2rsta de 18 ani, propor\u021bional cu perioada lucrat\u0103.<br><strong><em>Recomandare:<\/em><\/strong> Se recomand\u0103 specificarea \u020bn contractul individual de munc\u01ce at\u00e2t a duratei concediului de odihn\u01ce suplimentar de care beneficiaz\u01ce minorul p\u00e2n\u01ce \u020bn ziua anterioar\u01ce datei la care \u020bmplineste 18 ani, c\u00e2t \u0219i a duratei concediului de odihn\u01ce suplimentar de la data la care \u020bmplineste 18 ani.<\/p>\n\n\n\n<p class=\"has-text-align-center has-primary-color has-text-color has-link-color wp-elements-048d9b248958c4f5905c1bb78ea054f5\"><strong>Interdic\u0163ia angaj\u0103rii tinerilor<\/strong><\/p>\n\n\n\n<p><strong>Este interzis\u01ce \u020bncadrarea \u020bn munc\u01ce a urm\u01cetoarelor persoane fizice<\/strong>:<br><strong>-Sub 15 ani.<\/strong> De exemplu, o persoan\u01ce fizic\u01ce, ce \u020bmpline\u0219te v\u00e2rsta de 15 ani la data de 01 august 2024, poate \u020bncheia un contract individual de munc\u01ce \u020bncep\u00e2nd cu data de 01 august 2024, cu acordul p\u01cerin\u0163ilor sau al reprezentan\u0163ilor legali, \u020bn condi\u0163iile prev\u01cezute de legisla\u0163ia \u020bn vigoare. Anterior acestei date, \u00eencheierea unui contract individual de munc\u0103 este interzis\u0103.<br>&#8211;<strong>Aflate sub tutel\u01ce special\u01ce<\/strong>. De exemplu, o persoan\u01ce fizic\u01ce ce a \u020bmplinit v\u00e2rsta de 17 ani, aflat\u01ce sub tutela special\u01ce, \u020bn condi\u0163iile legii, nu poate \u020bncheia un contract individual de munc\u01ce.<br><strong>-Sub 18 ani,<\/strong> \u020bn locuri de munc\u01ce grele, v\u01cet\u01cem\u01cetoare sau periculoase, stabilite prin hot\u01cer\u00e2re a Guvernului.<\/p>\n\n\n\n<p>De asemenea, <strong>este interzis\u01ce angajarea tinerilor pentru activit\u01ce\u0163i care<\/strong>:<br><strong>a)<\/strong>dep\u0103\u015fesc \u00een mod evident capacit\u0103\u0163ile lor fizice sau psihologice;<br><strong>b)<\/strong>implic\u0103 o expunere nociv\u0103 la agen\u0163i toxici, cancerigeni, care determin\u0103 modific\u0103ri genetice ereditare, av\u00e2nd efecte nocive pentru f\u0103t pe durata gravidit\u0103\u0163ii sau av\u00e2nd orice alt efect nociv cronic asupra fiin\u0163ei umane;<br><strong>c)<\/strong>implic\u0103 o expunere nociv\u0103 la radia\u0163ii;<br><strong>d)<\/strong>prezint\u0103 riscuri de accidentare, pe care se presupune c\u0103 tinerii nu le pot identifica sau preveni, din cauza aten\u0163iei insuficiente pe care o acord\u0103 securit\u0103\u0163ii \u00een munc\u0103, a lipsei lor de experien\u0163\u0103 ori de preg\u0103tire;<br><strong>e)<\/strong>pun \u00een pericol s\u0103n\u0103tatea acestora din cauza frigului ori a c\u0103ldurii extreme sau din cauza zgomotului ori a vibra\u0163iilor.<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-color has-text-color has-link-color wp-elements-e9ec8b9261afdc92f87d97d67b9a0bdd\">Not\u0103: Informa\u021biile prezentate \u00een acest articol au caracter general \u0219i exclusiv informativ.
