{"id":789,"date":"2024-06-18T09:33:29","date_gmt":"2024-06-18T07:33:29","guid":{"rendered":"https:\/\/blog.fgo.ro\/?p=789"},"modified":"2025-02-19T17:56:39","modified_gmt":"2025-02-19T15:56:39","slug":"buletin-informativ-14-2024","status":"publish","type":"post","link":"https:\/\/www.fgo.ro\/blog\/buletin-informativ-14-2024\/","title":{"rendered":"BI 14\/2024: Concediul paternal \u020bn 2024"},"content":{"rendered":"<div class=\"wp-block-post-author\"><div class=\"wp-block-post-author__avatar\"><img alt='' src='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=48&#038;d=mm&#038;r=g' srcset='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=96&#038;d=mm&#038;r=g 2x' class='avatar avatar-48 photo' height='48' width='48' \/><\/div><div class=\"wp-block-post-author__content\"><p class=\"wp-block-post-author__byline\">Expert Fiscal \u0219i Expert Legisla\u0163ia Muncii, acreditat UNELM<\/p><p class=\"wp-block-post-author__name\">Ana Florina Carp<\/p><\/div><\/div>\n\n<div class=\"wp-block-post-date\"><time datetime=\"2024-06-18T09:33:29+02:00\">18\/06\/2024<\/time><\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Concediul paternal \u020bn 2024<\/strong><\/h2>\n\n\n\n<p>Concediul paternal se acord\u01ce \u020bn conformitate cu prevederile Legii 210\/1999 privind concediul paternal \u0219i a Normelor Metodologice de aplicare a acestei legi.<br>De acest concediu paternal poate beneficia <strong>tat\u01cel copilului nou-n\u01cescut<\/strong>, respectiv al copiilor nou-n\u01cescu\u0163i, \u020bn cazul sarcinilor multiple, care desf\u01ce\u0219oar\u01ce activitatea \u020bn baza unui unui <strong>contract individual de munc\u01ce<\/strong>.<\/p>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-a049c10caf297fb4cb0870cbae374bc0\"><strong>Concediul paternal<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>se acord\u01ce \u00een scopul de a asigura participarea efectiv\u0103 a tat\u0103lui la \u00eengrijirea copilului nou-n\u0103scut \u015fi de a facilita concilierea vie\u0163ii profesionale cu via\u0163a de familie \u00een cazul lucr\u0103torilor care sunt p\u0103rin\u0163i;<\/li>\n\n\n\n<li>se acord\u01ce tat\u0103lui copilului nou-n\u0103scut, respectiv al copiilor nou-n\u0103scu\u0163i, \u00een cazul sarcinilor multiple, care particip\u0103 efectiv la \u00eengrijirea acestuia, indiferent dac\u0103 copilul\/copiii, \u00een cazul sarcinilor multiple, este\/sunt n\u0103scut\/n\u0103scu\u0163i din c\u0103s\u0103torie, din afara c\u0103s\u0103toriei sau este adoptat\/sunt adopta\u0163i de titularul dreptului;<\/li>\n\n\n\n<li>are o durat\u01ce de <strong>10 zile lucr\u01cetoare<\/strong>. Durat\u01ce concediului paternal se poate <strong>majora cu 5 zile lucr\u01cetoare <\/strong>dac\u01ce tat\u01cel copilului nou n\u01cescut a ob\u0163inut atestatul de absolvire a cursului de puericultur\u01ce. Aceast\u01ce majorare se poate acorda pentru fiecare copil nou-n\u01cescut, respectiv pentru fiecare na\u0219tere \u020bn cazul sarcinilor multiple, <strong>pe baza atestatului de absolvire a cursului de puericultur\u01ce, indiferent c\u00e2nd acesta este ob\u0163inut.<\/strong><\/li>\n\n\n\n<li>se acord\u01ce la <strong>cererea scris\u01ce a salariatului<\/strong>, justificat cu certificatul de na\u0219tere al copilului\/copiilor, \u020bn cazul sarcinilor multiple;<\/li>\n\n\n\n<li>poate fi acordat doar <strong>\u020bn primele 8 s\u01cept\u01cem\u00e2ni <\/strong>de la na\u0219terea copilului\/copiilor, \u020bn cazul sarcinilor multiple;<\/li>\n\n\n\n<li>constituie vechime \u00een munc\u0103 \u015fi \u00een serviciu, precum \u015fi \u00een specialitate;<\/li>\n\n\n\n<li>constituie <strong>cauz\u01ce de suspendare<\/strong> a contractului individual de munc\u01ce la ini\u021biativa a salariatului. Suspendarea se completeaz\u01ce \u020bn Revisal \u0219i se transmite c\u01cetre ITM anterior primei zile de suspendare.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-c3d6763f05a792cc43bb1e9d27e5f9d0\"><strong>Indemniza\u0163ia de concediu paternal<\/strong><\/p>\n\n\n\n<p>Pe durata concediului paternal salariatul are dreptul la o indemniza\u0163ie care:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>se pl\u01cete\u0219te din fondul de salarii al angajatorului;<\/li>\n\n\n\n<li>este egal\u01ce cu salariul aferent zilelor lucr\u01cetoare respective;<\/li>\n\n\n\n<li>se calculeaz\u01ce pe baza salariului brut realizat, incluz\u00e2nd sporurile \u0219i adaosurile la salariul de baz\u01ce;<\/li>\n\n\n\n<li>se include \u020bn veniturile impozabile ale lucr\u01cetorului.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-e21dcd16347bd22787c1d0c0284d74ff\"><strong>Responsabilit\u01ce\u0163ile angajatorului<\/strong><\/p>\n\n\n\n<p>\u020an privin\u0163a concediului paternal, angajatorul are urm\u01cetoarele responsabilit\u01ce\u0163i:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>de a aproba <\/strong>concediul paternal;<\/li>\n\n\n\n<li><strong>de a informa angaja\u0163ii<\/strong> cu privire la dreptul lor la concediu paternal;<\/li>\n\n\n\n<li><strong>de a nu dispune \u020bncetarea<\/strong> raporturilor de munc\u01ce sau de serviciu \u020bn cazul lucr\u01cetorului care se afl\u01ce \u020bn concediu paternal, cu excep\u0163ia situa\u0163iei \u020bn care concedierea are loc pentru motive ce intervin ca urmare a reorganiz\u01cerii judiciare sau a falimentului angajatorului.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-primary-color has-text-color has-link-color wp-elements-7974aabdebca4a4222a5bf8bca45637e\"><strong>Alte categorii de persoane care pot beneficia de concediu paternal<\/strong><\/p>\n\n\n\n<p>Mai pot beneficia de concediu paternal \u0219i persoanele care desf\u01ce\u0219oar\u01ce activitatea astfel:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pe baza unor contracte de activitate sportiv\u01ce \u020bncheiate potrivit art.671 alin.(1) lit.a)-e) din Legea educa\u0163iei fizice \u0219i sportului nr.69\/2000;<\/li>\n\n\n\n<li>pe baza unor conven\u0163ii de munc\u01ce individuale \u020bncheiate potrivit Legii nr.1\/2005 privind organizarea \u0219i func\u0163ionarea coopera\u0163iei;<\/li>\n\n\n\n<li>pe baza contractelor de mandat \u020bncheiate potrivit Legii societ\u01ce\u0163ilor nr.31\/1990 (directorii);<\/li>\n\n\n\n<li>pe baza unor contracte de management \u020bncheiate potrivit Legii nr.66\/1993 privind contractul de management;<\/li>\n\n\n\n<li>pe baza unor contracte de management \u0219i de administrare \u020bncheiate potrivit Legii nr.95\/2006 privind reforma \u020bn domeniul s\u01cen\u01cet\u01ce\u0163ii.<\/li>\n\n\n\n<li>cele care ocup\u01ce o func\u0163ie de demnitate public\u01ce.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-cyan-bluish-gray-color has-text-color has-link-color wp-elements-54e5ee12971b0024d79695dbb545aa17\">Not\u0103: autorul nu este r\u0103spunz\u0103tor pentru nicio pierdere cauzat\u0103 vreunei persoane juridice sau fizice, care ac\u0163ioneaz\u0103 sau se ab\u0163ine de la ac\u0163iuni ca urmare a citirii informa\u0163iilor din acest buletin informativ.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Concediul paternal \u020bn 2024 Concediul paternal se acord\u01ce \u020bn conformitate cu prevederile Legii 210\/1999 privind concediul paternal \u0219i a Normelor Metodologice de aplicare a acestei legi.De acest concediu paternal poate beneficia tat\u01cel copilului nou-n\u01cescut, respectiv al copiilor nou-n\u01cescu\u0163i, \u020bn cazul sarcinilor multiple, care desf\u01ce\u0219oar\u01ce activitatea \u020bn baza unui unui contract individual de munc\u01ce.
