class=\"wp-block-heading\"><strong>Obliga\u021biile angajatorilor \u00een raport cu ANOFM<\/strong><\/h2>\n\n\n\n<p>Pu\u0163ini angajatori cunosc \u0219i pun \u020bn aplicare prevederile Legii 76\/2002 privind sistemul asigur\u01cerilor pentru \u0219omaj \u0219i stimularea ocup\u01cerii for\u0163ei de munc\u01ce, precum \u0219i a Normelor Metodologice de aplicare a acestei legi, cu privire la comunicarea locurilor de munc\u01ce vacante \u0219i a ocup\u01cerii lor.<\/p>\n\n\n\n<p>Pe parcursul desf\u01ce\u0219ur\u01cerii activit\u01ce\u0163ii, to\u0163i angajatorii, indiferent de forma de organizare, \u020bnt\u00e2lnesc situa\u0163ii \u020bn care un loc de munc\u01ce <strong>devine vacant<\/strong>, <strong>se ocup\u01ce<\/strong>, sau <strong>se desfiin\u0163eaz\u01ce<\/strong>. <\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong><strong>Ce se \u020bn\u0163elege prin loc de munc\u01ce vacant<\/strong>?<\/strong><\/p>\n\n\n\n<p>Conform art.3 alin.(1) din Normele Metodologice de aplicare a Legii 76\/2002, <strong>locurile de munc<\/strong><strong>\u01ce<\/strong><strong> vacante sunt<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>locurile de munc\u0103 devenite disponibile<\/strong> ca urmare a \u00eencet\u0103rii raporturilor de munc\u0103 sau de serviciu<\/li>\n\n\n\n<li><strong>locurile de munc\u0103 nou-create<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>Obliga\u0163iile angajatorilor<\/strong> <strong>fa\u0163\u01ce de ANOFM<\/strong><\/p>\n\n\n\n<p>Potrivit art.10 alin.(1) si (3) din Legea 76\/2002, angajatorii au urm\u01cetoarele obliga\u0163ii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>s\u0103 comunice c\u01cetre AJOFM\/ANOFM toate locurile de munc\u0103 vacante, \u00een <strong>termen de 5 zile lucr<\/strong><strong>\u0103<\/strong><strong>toare<\/strong> de la vacantarea lor;<\/li>\n\n\n\n<li>s\u0103 comunice c\u01cetre AJOFM\/ANOFM ocuparea locurilor de munc\u0103 vacante \u00een <strong>termen de o zi de la data ocup<\/strong><strong>\u0103<\/strong><strong>rii acestora<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Angajatorii comunic\u01ce locurile de munc\u01ce vacante \u0219i ocuparea lor c\u01cetre agen\u0163iile pentru ocuparea for\u0163ei de munc\u0103 jude\u0163ene, respectiv a municipiului Bucure\u015fti, \u00een a c\u0103ror raz\u0103 teritorial\u01ce \u00ee\u015fi au sediul\/domiciliul.<\/p>\n\n\n\n<p>Au aceste obliga\u0163ii to\u0163i angajatorii, a\u0219a cum sunt definiti la art.5 din Legea 76\/2002:<br><strong>&#8211;<\/strong>persoane juridice sau fizice, cu sediul\/domiciliul \u020bn Rom\u00e2nia,<br><strong>&#8211;<\/strong>sucursale, filiale, agen\u0163ii, reprezentan\u0163e din Rom\u00e2nia a unei persoane juridice str\u0103ine cu sediul \u00een str\u0103in\u0103tate, autorizate potrivit legii, care \u00eencadreaz\u0103 for\u0163\u0103 de munc\u0103 \u00een condi\u0163iile legii.<\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>Cum calcul\u01cem termenele de comunicare?<\/strong><\/p>\n\n\n\n<p>Normele metodologice de aplicare a Legii 76\/2002 prev\u01ced \u0219i cum se calculeaz\u01ce termenele de comunicare a locurilor de munc\u01ce vacante \u0219i ocuparea lor.<\/p>\n\n\n\n<p><strong>Termenul de 5 zile lucr<\/strong><strong>\u01ce<\/strong><strong>toare<\/strong> pentru comunicarea locului de munc\u01ce vacant \u201ese \u00eendepline\u015fte la sf\u00e2r\u015fitul celei de a 5-a zile lucr\u0103toare, ora 24.00, din perioada de 5 zile lucr\u0103toare de la vacantarea locului de munc\u0103.\u201d<\/p>\n\n\n\n<p>Acest termen se calculeaz\u01ce astfel:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>de la data vacant\u01cerii\/cre\u01cerii locului de munc\u01ce, dac\u01ce aceast\u0103 dat\u0103 nu este declarat\u0103 zi nelucr\u0103toare,<\/li>\n\n\n\n<li>\u020bncep\u00e2nd cu prima zi lucr\u0103toare, \u00een situa\u0163ia \u00een care vacantarea locului de munc\u0103 s-a realizat \u00eentr-o zi declarat\u0103 nelucr\u0103toare.<\/li>\n<\/ul>\n\n\n\n<p><strong>Termenul de o zi<\/strong> de la data ocup\u0103rii locului de munc\u0103 \u201ese \u00eendepline\u015fte la sf\u00e2r\u015fitul primei zile lucr\u0103toare, ora 24:00, urm\u0103toare datei \u00een care s-a ocupat locul de munc\u0103 \u00een condi\u0163iile legii.\u201d<\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>Cum se realizeaz\u01ce comunicarea locurilor de munc\u01ce vacante \u0219i a ocup\u01cerii lor?<\/strong><\/p>\n\n\n\n<p>Mijlocul recomandat pentru transmiterea locurile de munc\u0103 vacante \u0219i ocuparea acestora este prin intermediul <strong>Platformei ANOFM PULS<\/strong>, lansat\u0103 \u00een septembrie 2024.<\/p>\n\n\n\n<p><strong>Platforma ANOFM PULS<\/strong> permite gestionarea \u00eentr-un singur loc a:<br>\u2192declar\u0103rii locurilor de munc\u0103 vacante,<br>\u2192comunic\u0103rii ocup\u0103rii acestora,<br>\u2192actualiz\u0103rii datelor angajatorului,<br>\u2192accesului la eviden\u021be \u0219i la istoricul declara\u021biilor.<\/p>\n\n\n\n<p>Pentru a utiliza platforma, angajatorii se pot \u00eenregistra <a href=\"https:\/\/puls.anofm.ro\/#\/register\" target=\"_blank\" rel=\"noreferrer noopener\">aici<\/a> \u0219i pot ob\u0163ine detalii privind \u00eenregistrarea \u020bn platforma ANOFM PULS acces\u00e2nd link-ul: <a href=\"https:\/\/docs.ngeneration.ro\/docs\/documentatie\/\" target=\"_blank\" rel=\"noreferrer noopener\">Informa\u021bii pentru angajatori \u2013 DOCS<\/a><\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>Actualizarea organigramei \u0219i a documentelor interne ale angajatorului<\/strong><\/p>\n\n\n\n<p>Atunci c\u00e2nd un post este \u00eenfiin\u021bat, modificat sau desfiin\u021bat, este important ca aceste schimb\u0103ri s\u0103 fie reflectate \u0219i \u00een structura organizatoric\u0103 intern\u0103. \u00cen practic\u0103, aceasta presupune:<br>\u2192emiterea unei <strong>decizii de \u00eenfiin\u021bare\/desfiin\u021bare<\/strong> a postului;<br><strong>\u2192actualizarea organigramei <\/strong>\u0219i, dup\u0103 caz, a statului de func\u021bii;<br>\u2192arhivarea documentelor \u0219i corelarea lor cu eviden\u021bele transmise c\u0103tre ANOFM.<br>Pe platforma FGO sunt disponibile <strong>modele de decizii <\/strong>care pot fi folosite pentru documentarea acestor modific\u0103ri interne.<\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>Sanc\u0163iuni<\/strong><\/p>\n\n\n\n<p>Necomunicarea locurilor de munc\u01ce vacante \u0219i a ocup\u01cerii lor, \u020bn termenele prev\u01cezute mai sus, constituie <strong>contraven\u0163ie<\/strong> \u0219i se sanc\u0163ioneaz\u01ce cu <strong>amend\u01ce de la 3000 lei la 5000 lei<\/strong>.<\/p>\n\n\n\n<p class=\"has-base-color has-vivid-purple-background-color has-text-color has-background has-link-color wp-elements-2d6e694f93f9ee539b44f5564b0fe4eb\"><strong>Exemplul 1<\/strong><\/p>\n\n\n\n<p>\u020an primul exemplu avem salariatul X, \u020bncadrat pe func\u0163ia de contabil, al c\u01cerui contract individual de munc\u01ce \u020bnceteaz\u01ce pe data de 23 martie 2024. <br>Prin urmare, de la data de 23 martie 2024, postul de contabil, ce a fost ocupat de salariatul X, devine disponibil \u020bn vederea ocup\u01cerii lui de c\u01cetre o alta persoan\u01ce, (devine vacant).  <\/p>\n\n\n\n<p>\u020an aceast\u01ce situa\u0163ie angajatorul are obliga\u0163ia de a declara la ANOFM vacantarea postului de contabil. Ultima zi \u020bn care angajatorul poate declara vacantarea acestui post \u020bn termenul legal este 29 martie 2024.<\/p>\n\n\n\n<p class=\"has-base-color has-vivid-purple-background-color has-text-color has-background has-link-color wp-elements-c86e812e8ccc1f4288167013173e49a4\"><strong>Exemplul 2<\/strong><\/p>\n\n\n\n<p>Un alt exemplu ar fi cel \u020bn care angajatorul nu mai dore\u0219te s\u01ce angajeze o alt\u01ce persoan\u01ce, pe postul de contabil, \u020bn locul salariatului X, al c\u01cerui contract individual de munc\u01ce \u020bnceteaz\u01ce pe data de 23 martie 2024. <\/p>\n\n\n\n<p>Prin urmare, la data de 23 martie 2024, postul de contabil se desfiin\u0163eaz\u01ce prin decizia angajatorului, situa\u0163ie \u020bn care angajatorul nu are obliga\u0163iile de comunicare c\u01cetre ANOFM, prev\u01cezute mai sus.<\/p>\n\n\n\n<p class=\"has-base-color has-vivid-purple-background-color has-text-color has-background has-link-color wp-elements-a14e887e1132c7b8ad3e890fb5d3cbd6\"><strong>Exemplul 3<\/strong><\/p>\n\n\n\n<p>Salariatului X, ce ocup\u01ce func\u0163ia de contabil, urmeaz\u01ce s\u01ce \u020bi \u020bnceteze contractul individual de munc\u01ce pe data de 30 martie 2024, prin demisie. P\u00e2n\u01ce la acea dat\u01ce angajatorul \u020bncheie un contract individual de munc\u01ce cu salariatul Y, \u020bncadrat pe func\u0163ia de contabil, ce va prelua atribu\u0163iile salariatului X. <\/p>\n\n\n\n<p>Av\u00e2nd \u020bn vedere c\u01ce postul ocupat de salariatul X devine vacant abia de la data de 30 martie 2024, angajatorul va crea un nou post de contabil pentru salariatul Y, prin decizie scris\u01ce. <\/p>\n\n\n\n<p>\u020an privin\u0163a postului de contabil, ocupat de salariatul Y, obliga\u0163iile angajatorului fa\u0163\u01ce de ANOFM sunt:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>comunicarea postului de contabil, nou creat, \u020bn termen de 5 zile lucr\u01cetoare de la creare,<\/li>\n\n\n\n<li>comunicarea ocuparii acestui post de c\u01cetre salariatul Y, \u020bn termen de o zi de la data ocup\u01cerii.<\/li>\n<\/ul>\n\n\n\n<p>\u020an privin\u021ba postului de contabil, ocupat de salariatul X, angajatorul va decide dac\u01ce, de la data de 30 martie 2024:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>r\u01cem\u00e2ne vacant, urm\u00e2nd s\u01ce il comunice c\u01cetre ANOFM, \u020bn termenul de mai sus, sau<\/li>\n\n\n\n<li>se desfiin\u0163eaz\u01ce, situa\u0163ie \u020bn care angajatorul nu are obliga\u0163ie de comunicare c\u01cetre ANOFM.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-color has-text-color has-link-color wp-elements-58040d9ae9f0e53ece71561e73424acc\">Not\u0103: Informa\u021biile prezentate \u00een acest buletin informativ au caracter general \u0219i exclusiv informativ. FGO \u0219i autorul nu \u00ee\u0219i asum\u0103 r\u0103spunderea pentru eventualele pierderi sau prejudicii rezultate \u00een urma utiliz\u0103rii acestor informa\u021bii.
