{"id":1550,"date":"2025-10-27T12:16:58","date_gmt":"2025-10-27T10:16:58","guid":{"rendered":"https:\/\/www.fgo.ro\/blog\/?p=1550"},"modified":"2025-10-27T12:16:58","modified_gmt":"2025-10-27T10:16:58","slug":"bi-16-2025-legea-nr-149-2025-noi-drepturi-pentru-salariatii-care-au-copii-in-intretinere","status":"publish","type":"post","link":"https:\/\/www.fgo.ro\/blog\/bi-16-2025-legea-nr-149-2025-noi-drepturi-pentru-salariatii-care-au-copii-in-intretinere\/","title":{"rendered":"BI 16\/2025: Legea nr. 149\/2025: Noi drepturi pentru salaria\u021bii care au copii \u00een \u00eentre\u021binere"},"content":{"rendered":"<div class=\"wp-block-post-date\"><time datetime=\"2025-10-27T12:16:58+02:00\">27\/10\/2025<\/time><\/div>\n\n<div class=\"wp-block-post-author\"><div class=\"wp-block-post-author__avatar\"><img alt='' src='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=48&#038;d=mm&#038;r=g' srcset='https:\/\/secure.gravatar.com\/avatar\/e82f2c3a815d502be7669919e815af0cc255f7281fbe5c149293517033fee54c?s=96&#038;d=mm&#038;r=g 2x' class='avatar avatar-48 photo' height='48' width='48' \/><\/div><div class=\"wp-block-post-author__content\"><p class=\"wp-block-post-author__byline\">Expert Fiscal \u0219i Expert Legisla\u0163ia Muncii, acreditat UNELM<\/p><p class=\"wp-block-post-author__name\">Ana Florina Carp<\/p><\/div><\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong>Dreptul de a lucra \u00een telemunc\u0103 sau la domiciliu pentru salaria\u021bii care au \u00een \u00eentre\u021binere copii cu v\u00e2rsta de p\u00e2n\u0103 la 18 ani.<\/strong><\/h2>\n\n\n\n<p>Pe data de 9 octombrie 2025, \u00een Monitorul Oficial nr. 936, Partea I, a fost publicat\u0103 <strong>Legea nr. 149\/2025<\/strong>, care completeaz\u0103 art. 118\u00b9 din Codul Muncii cu alineatele (4)\u2013(7).<br>Actul normativ a intrat \u00een vigoare pe 12 octombrie 2025 \u0219i are ca scop sprijinirea salaria\u021bilor care au \u00een \u00eentre\u021binere copii cu dizabilit\u0103\u021bi sau mai mul\u021bi copii minori.<\/p>\n\n\n\n<p>\ud83d\udd39<strong>Forma art 118<sup>1<\/sup> (p\u00e2n\u0103 la 11 octombrie 2025)<\/strong><\/p>\n\n\n\n<p>P\u00e2n\u0103 la intrarea \u00een vigoare a noii legi, art. 118\u00b9 din Codul muncii acorda 4 zile pe lun\u0103 de munc\u0103 la domiciliu sau \u00een regim de telemunc\u0103 pentru salaria\u021bii care au \u00een \u00eentre\u021binere copii de p\u00e2n\u0103 la 11 ani dac\u0103 natura activit\u0103\u021bii permite acest lucru \u0219i \u00een baza unei cereri depuse.<\/p>\n\n\n\n<p>\ud83d\udd39<strong>Ce aduce nou Legea nr. 149\/2025?<\/strong><\/p>\n\n\n\n<p>\u00cencep\u00e2nd cu 12 octombrie 2025, articolul 118\u00b9 va cuprinde \u0219apte alineate, prin care se extinde \u0219i diferen\u021biaz\u0103 dreptul de munc\u0103 la domiciliu\/telemunc\u0103:<br>\u2705 <strong>Alineatul (4)<\/strong><br>Salaria\u021bii care au \u00een \u00eentre\u021binere copii cu v\u00e2rsta de p\u00e2n\u0103 la 18 ani \u00eencadra\u021bi \u00een grad de handicap beneficiaz\u0103 de 8 zile pe lun\u0103 de munc\u0103 la domiciliu sau telemunc\u0103.<br>\u2705 <strong>Alineatul (5)<\/strong><br>Pentru salaria\u021bii care au \u00een \u00eentre\u021binere 2 sau mai mul\u021bi copii cu handicap, se acord\u0103 c\u00e2te dou\u0103 zile suplimentare pentru fiecare copil, peste cele 8 zile prev\u0103zute la alin. (4).<br>\u2705 <strong>Alineatul (6)<\/strong><br>Acelea\u0219i drepturi de la alin. (5) se extind \u0219i pentru p\u0103rin\u021bii care au \u00een \u00eentre\u021binere copii gemeni, triple\u021bi sau multiple\u021bi, cu v\u00e2rsta de p\u00e2n\u0103 la 18 ani.<br>\u2705 <strong>Alineatul (7)<\/strong><br>Cererea salariatului trebuie s\u0103 fie \u00eenso\u021bit\u0103, dup\u0103 caz, de certificatul de \u00eencadrare \u00eentr-un grad de handicap al copilului, eliberat potrivit legii.<\/p>\n\n\n\n<p>\ud83d\udd39<strong>Condi\u021biile \u00een care se acord\u0103 aceste drepturi<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Se acord\u0103 <strong>doar dac\u0103 natura sau felul muncii permite<\/strong> desf\u0103\u0219urarea activit\u0103\u021bii la domiciliu sau \u00een telemunc\u0103. Posturile care impun prezen\u021ba salariatului exclusiv\u0103 la sediul angajatorului nu sunt eligibile.<\/li>\n\n\n\n<li>Beneficiarii: <strong>p\u0103rin\u021bii sau reprezentan\u021bii legali<\/strong> care au calitatea de salariat.<\/li>\n\n\n\n<li>Drepturile se acord\u0103 <strong>la cererea salariatului<\/strong>.<\/li>\n\n\n\n<li>Cererea trebuie s\u0103 fie \u00eenso\u021bit\u0103, dup\u0103 caz, de <strong>certificatul de \u00eencadrare \u00eentr-un grad de handicap al copilului,<\/strong> eliberat potrivit legii.<\/li>\n\n\n\n<li>Salariatul trebuie s\u0103 dispun\u0103 de <strong>mijloacele necesare<\/strong> pentru desf\u0103\u0219urarea activit\u0103\u021bii de la distan\u021b\u0103 (de exemplu: echipamente, conexiune la internet, etc).<\/li>\n\n\n\n<li>Dac\u0103 ambii p\u0103rin\u021bi sau reprezentan\u021bi legali sunt angaja\u021bi, <strong>doar unul dintre ei poate beneficia<\/strong> de aceste drepturi pentru aceea\u0219i perioad\u0103. \u2192 declara\u021bia pe propria r\u0103spundere din care s\u0103 rezulte c\u0103 cel\u0103lalt p\u0103rinte sau reprezentant legal nu a solicitat drepturile \u00een aceea\u0219i perioada.<\/li>\n\n\n\n<li><strong>Excep\u021bie<\/strong>: salaria\u021bii afla\u021bi \u00een situa\u021biile reglementate de <strong>art.3 din Legea nr. 277\/2010<\/strong> privind aloca\u021bia pentru sus\u021binerea familiei <strong>nu mai trebuie s\u0103 depun\u0103 declara\u021bia<\/strong>.<br>Situa\u021biile prev\u0103zute la art. 3 din Legea 277\/2010 includ:<br>a) nec\u0103s\u0103torit\/\u0103;<br>b) v\u0103duv\/\u0103;<br>c) divor\u021bat\/\u0103;<br>d) so\u021bul\/so\u021bia declarat\/declarat\u0103 disp\u0103rut\/\u0103 prin hot\u0103r\u00e2re judec\u0103toreasc\u0103;<br>e) so\u021bul\/so\u021bia arestat\/\u0103 preventiv &gt;30 zile sau execut\u0103 pedeaps\u0103 privativ\u0103 de libertate \u0219i nu particip\u0103 la \u00eentre\u021binerea copiilor;<br>f) minor sub 18 ani \u00een una dintre situa\u021biile a)\u2013e);<br>g) tutore sau persoana c\u0103reia i s-au \u00eencredin\u021bat ori i s-au dat \u00een plasament unul sau mai mul\u021bi copii \u0219i se afl\u0103 \u00een una dintre situa\u021biile prev\u0103zute la lit. a)-c).<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong>CEREREA:<\/strong><\/p>\n\n\n\n<p>-se formuleaz\u0103 <strong>\u00een scris<\/strong> (electronic sau pe suport h\u00e2rtie, \u00een func\u021bie de procedura intern\u0103 a angajatorului) \u0219i se adreseaz\u0103 angajatorului \u00eenso\u021bit\u0103, dup\u0103 caz, de certificatul de \u00eencadrare \u00een grad de handicap al copilului, eliberat potrivit legii.<br>-trebuie s\u0103 con\u021bin\u0103 <strong>perioada<\/strong> pentru care se solicit\u0103 lucrul la domiciliu\/telemunc\u0103 \u0219i <strong>precizarea<\/strong> dac\u0103 ambii p\u0103rin\u021bi sunt salaria\u021bi (\u00eenso\u021bit\u0103 de declara\u021bie, dac\u0103 este cazul).<br>-se analizeaz\u0103 de c\u0103tre angajator, \u00een baza descrierii postului\/ROF sau a Regulamentului Intern.<\/p>\n\n\n\n<p>\ud83d\udd39<strong>Plata \u0219i natura zilelor<\/strong><\/p>\n\n\n\n<p>Zilele acordate \u00een baza art.118<sup>1<\/sup> din Codul Muncii sunt <strong>zile de munc\u0103 efectiv\u0103, desf\u0103\u0219urate la domiciliu\/\u00een telemunc\u0103<\/strong>.<br>Pentru a fi pl\u0103tite salariatul:<br>-trebuie s\u0103 presteze munca convenit\u0103;<br>-s\u0103 \u00ee\u0219i exercite atribu\u021biile conform fi\u0219ei postului;<br>-s\u0103 respecte programul de lucru.<br>Condi\u021biile de remunerare sunt cele prev\u0103zute \u00een contractul individual\/colectiv de munc\u0103 \u0219i \u00een legisla\u021bia muncii aplicabil\u0103.<\/p>\n\n\n\n<p>\ud83d\udd39<strong>Aspecte practice pentru angajatori<\/strong><\/p>\n\n\n\n<p>-\u00eentocmirea<strong> Regulamentului de Organizare \u0219i Func\u021bionare <\/strong>(ROF), cu descrierea posturilor pentru a stabili care post permite desf\u0103\u0219urarea activit\u0103\u021bii de la domiciliu sau \u00een telemunc\u0103<br>-\u00een lipsa ROF-ului, se poate include o sec\u021biune cu descrierea posturilor \u00een <strong>Regulamentul Intern <\/strong>al companiei.<br>Dac\u0103 postul ocupat de salariat presupune desf\u0103\u0219urarea activit\u0103\u021bii exclusiv la sediul angajatorului, acesta nu poate beneficia de drepturile prev\u0103zute la art. 118\u00b9.<br>-Stabilirea unei proceduri interne privind formularea cererii.<\/p>\n\n\n\n<p>Drepturile salaria\u021bilor \u00eencep\u00e2nd cu 12
